LEGISLATIA MUNCII<\/h3>\n<\/div>\n<\/div>\n<\/div>\n<div id=\"sppb-addon-wrapper-1589793277348\" class=\"sppb-addon-wrapper\">\n<div id=\"sppb-addon-1589793277348\" class=\"clearfix \">\n<div class=\"sppb-addon sppb-addon-text-block  \">\n<div class=\"sppb-addon-content\">\n<p>Consideram ca din multitudinea de aspecte pe care trebuie sa le cunoastem cu privire la legislatia muncii este important capitolul despre contractul de munca .<br \/><strong>Contractul individual de munc\u0103<\/strong>\u00a0este contractul \u00een temeiul c\u0103ruia o persoan\u0103 fizic\u0103, denumit\u0103 salariat, se oblig\u0103 s\u0103 presteze munca pentru \u015fi sub autoritatea unui angajator, persoan\u0103 fizic\u0103 sau juridic\u0103, \u00een schimbul unei remunera\u0163ii denumite salariu.<br \/>Entitatile medicale , indiferent de forma de organizare (C.M.I, S.R.L., SOCIETATI CIVILE MEDICALE , CABINETE ASOCIATE ) pot incheia contracte individuale de munca pentru fiecare persoana care presteaza o activitate in cadrul acesteia( medic, asistenta, femeie de serviciu, administrator, contabil , jurist,etc.).Contractul de munca este cel care asigura\u00a0vechimea in munca.<br \/>La\u00a0 forma de organizare S.R.L. medicul titular isi poate incheia contract individual de munca pentru persoana sa, la CMI nu se poate autoangaja.<br \/><strong><br \/>Incheierea contractului individual de munca ( Art. 16 \u2013Codul Muncii)<\/strong><br \/>(1) Contractul individual de munc\u0103 se \u00eencheie \u00een baza consim\u0163\u0103m\u00e2ntului p\u0103r\u0163ilor, \u00een form\u0103 scris\u0103, \u00een limba rom\u00e2n\u0103,\u00a0<strong>anterior inceperii activitatii<\/strong>. Obliga\u0163ia de \u00eencheiere a contractului individual de munc\u0103 \u00een form\u0103 scris\u0103 revine angajatorului(C.M.I, S.R.L., SOCIETATE CIVILA MEDICALA, CABINET ASOCIAT) Forma scris\u0103 este obligatorie pentru \u00eencheierea valabil\u0103 a contractului.<br \/>(2) Anterior \u00eenceperii activit\u0103\u0163ii, contractul individual de munc\u0103\u00a0<strong>se \u00eenregistreaz\u0103<\/strong>\u00a0\u00een registrul general de eviden\u0163\u0103 a salaria\u0163ilor, care\u00a0<strong>se transmite inspectoratului teritorial\u00a0<\/strong>de munc\u0103.(in prezent se transmite on line, pe baza unei parole care se obtine de la I.T.M Bihor)<br \/>(3) Angajatorul este obligat ca, anterior \u00eenceperii activit\u0103\u0163ii, s\u0103 \u00eenm\u00e2neze salariatului un exemplar din contractul individual de munc\u0103.<br \/>(4) Munca prestat\u0103 \u00een temeiul unui contract individual de munc\u0103 constituie vechime \u00een munc\u0103.<br \/><strong>Neincheierea in forma scrisa a contractului individual de munca se sanctioneaza cu amenda 10.000-20.000 pentru fiecare persoana identificata.<\/strong><br \/>La incheierea contractului individual de munca este necesar certificat care sa ateste capacitatea angajatului de a presta activitatea pentru care este angajat ( FISA DE APTITUDINI eliberata de medicul de medicina muncii ).<br \/>Contractul individual de munca se transmite online catre I.T.M. pe baza unei parole care se obtine de la I.T.M. Bihor. Orice modificare a contractului se transmite de asemenea online.<\/p>\n<p>Anexe\u00a0obligatorii\u00a0ale contractului individual de munca :<\/p>\n<ul>\n<li>fisa de aptitudini ,\u00a0<strong>care trebuie obtinuta anuala<\/strong>\u00a0(lipsa ei atrage amenda de 3000 ron)<\/li>\n<li><span><em><strong>fisa postului medic dentist<\/strong><\/em><\/span>, descarc\u0103\u00a0model orientativ<\/li>\n<li><span><em><strong>fisa postului asistent stomatologie<\/strong><\/em><\/span>, descarc\u0103\u00a0model orientativ<\/li>\n<li>fisa de evaluare performante personal angajat<\/li>\n<li>fisa de sanatate si securitate in munca (de preferat sa se externalizeze serviciul privind protectia securitatii si sanatatii in munca .Sunt firme specializate in acest domeniu)<\/li>\n<\/ul>\n<p><strong>Grila de control solicitata de I.T.M. Bihor in cazul unei inspectii la cabinetul dvs. cuprinde urmatoarele acte:<\/strong><\/p>\n<ul>\n<li>acte constitutive societate(cabinet individual)<\/li>\n<li>dosare de personal ale angajatilor societatii(care trebuie sa cuprinda :B.I., certificat nastere, certificat casatorie, fisa aptitudini, fisa postului, diploma de studii,declaratie de traseu, fisa evaluare performante, fise de protectia muncii)<\/li>\n<li>state de plata a salariilor, atentie,\u00a0<strong>SEMNATE DE SALARIATI!<\/strong><\/li>\n<li>foi colective de prezenta ( pontaje)<\/li>\n<li>registrul unic de control<\/li>\n<li>regulament de ordine interioara<\/li>\n<li>registru general de evidenta salariati<\/li>\n<li>planificare concedii de odihna<\/li>\n<\/ul>\n<p>Bibliografie: Codul Muncii-actualizat 2012 : Legea 319\/2006<\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div id=\"sppb-addon-wrapper-1589794920295\" class=\"sppb-addon-wrapper\">\n<div id=\"sppb-addon-1589794920295\" class=\"clearfix \">\n<div class=\"sppb-addon sppb-addon-header sppb-text-left\">\n<h3 class=\"sppb-addon-title\">2. INFIIN\u021aAREA UNUI CABINET DE MEDICIN\u0102 DENTAR\u0102<\/h3>\n<\/div>\n<\/div>\n<\/div>\n<div id=\"sppb-addon-wrapper-1589794920300\" class=\"sppb-addon-wrapper\">\n<div id=\"sppb-addon-1589794920300\" class=\"clearfix \">\n<div class=\"sppb-addon sppb-addon-text-block  \">\n<div class=\"sppb-addon-content\">\n<div>In conformitate cu legislatia in vigoare activitatea de medic dentist se poate efectua in urmatoarele modalitati:<\/div>\n<div>\n<ul>\n<li>societate comerciala cu raspundere limitata (S.R.L.)<\/li>\n<li>cabinet medical individual(C.M.I.)<\/li>\n<li>cabinete medicale asociate<\/li>\n<li>societati civile medicale<\/li>\n<\/ul>\n<\/div>\n<div>In continuare vom incerca sa va prezentam aspecte referitoare la infiintare celor mai uzuale entitati dentare :S.R.L. si C.M.I<\/div>\n<div><strong>a. Organizare sub forma de S.R.L.<\/strong><\/div>\n<div>Pasii sunt urmatorii:<\/div>\n<div>a)Infiintare S.R.L.-Procedeul se deruleaza prin Registrul Comertului , actele necesare fiind solicitate de la aceasta institutie .In vederea infiintarii este necesara deschidere de cont la o institutie bancara .In cazul in care se doreste contract cu C.A.S. este necesara si deschidere de cont la Trezorerie.<\/div>\n<div>b)Inregistrare la Administratia Financiara (in functie de domiciliu) a S.R.L.-ului infiintat<\/div>\n<div>c)Achizitie stampila cu datele firmei .<\/div>\n<div>d)Cumparare registru unic de control ( de la Administratia Financiara)+registru incasari plati+registru inventar<\/div>\n<div>e)Achizitie casa de marcat fiscala+fiscalizare la Administratia Finaciara<\/div>\n<div>f)Certificat de inregistrare emis de Colegiul Medicilor Dentisti<\/div>\n<div>g)Aviz de functionare emis de Colegiul Medicilor Dentisti<\/div>\n<div>g)Autorizatie Sanitara de Functionare emisa de Directia De Sanatate Publica<\/div>\n<div>Din acest moment in unitatea respectiva se poate desfasura activitate stomatologica.<\/div>\n<div><strong><em>Dezavantaje:<\/em><\/strong><\/div>\n<div>\n<ul>\n<li>contabilitate in partida dubla ( necesita contabil autorizat)<\/li>\n<li>obligativitate incheiere contract individual de munca chiar si pentru administrator (costuri suplimentare)<\/li>\n<li>obligativitate casa de marcat fiscala<\/li>\n<\/ul>\n<\/div>\n<div><strong>b. Organizare sub forma de C.M.I.<\/strong><\/div>\n<div>Procedura se deruleaza prin Colegiul Medicilor Dentisti si presupune urmatorii pasi<\/div>\n<div>a)Eliberare Certificat De inregistrare- emis de Colegiul Medicilor &#8211; Acte necesare: dovada detinere spatiu (proprietate sau inchiriere), schita spatiului, copie libera practica, dovada platii la zi a contributiei CMDR<\/div>\n<div>b)Inregistrare Administratia Financiara si eliberare Certificat de inregistrare fiscala.( se completeaza declaratia 070 pentru inregistrare si apoi se completeaza declaratia 020 in care estimati un venit aproximativ in anul in curs pe baza careia se calculeaza impozitul .De preferat aceasta delcratie sa nu fie cu un venit foarte mare )<\/div>\n<div>c)Achizitie registru unic de control de la Administratia Financiara+registru inventar +registru incasari plati.<\/div>\n<div>d) Achizitie stampila cu datele firmei<\/div>\n<div>e)Inregistrare in registrul unic al cabinetelor medicale \u2013la Directia de Sanatate Publica<\/div>\n<div>f)Autorizatie sanitara de functionare<\/div>\n<div><strong>In principiu din acest moment puteti functiona<\/strong><\/div>\n<div>Este bine de stiut pentru ca reprezentantul legal sa poata benficia de vechime in munca se incheie:<\/div>\n<div>\n<ul>\n<li>declaratie de asigurare la Casa de Pensii<\/li>\n<li>declaratie de asigurare la Casa de Sanatate<\/li>\n<\/ul>\n<\/div>\n<div><em><strong>Avantaje<\/strong><\/em><\/div>\n<div>\n<ul>\n<li>contributiile catre stat se calculeaza pe baza veniturilor realizate<\/li>\n<li>nu este necesara casa de marcat<\/li>\n<li>nu este necesar contabil autorizat, nu se depun declaratii lunare , nu se intocmesc balante si bilanturi<\/li>\n<\/ul>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div id=\"sppb-addon-wrapper-1589794920305\" class=\"sppb-addon-wrapper\">\n<div id=\"sppb-addon-1589794920305\" class=\"clearfix \">\n<div class=\"sppb-addon sppb-addon-header sppb-text-left\">\n<h3 class=\"sppb-addon-title\">3.
